1. Who you are contracting with

nekos.love (the "Service") is operated by Rogério Paulo Magalhães Videira de Sousa Ribeiro (the "Seller", "we", "us"). By creating an account or using the Service you (the "User") agree to these Terms. If you are using the Service on behalf of an organisation, you confirm you have the authority to bind it. If you are an individual, you confirm you are of legal age in your country.

2. The Service

nekos.love is a private diary, album and memory book for cats. Free accounts are limited to one cat; the paid "Love" plan unlocks unlimited cats, family sharing, collections and pinned moments. Features may evolve over time.

3. Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your credentials confidential and for all activity under your account.

4. Acceptable use

You must not, and must not permit anyone else to:

• use the Service in any way that breaks the law;
• use the Service for fraud, spam, harassment or abuse;
• upload content that infringes any third party's intellectual property or privacy rights;
• upload malware or otherwise interfere with the security or integrity of the Service;
• probe, scan, scrape or test the Service or its infrastructure without our written permission;
• reverse engineer, resell, redistribute or circumvent the technical limits of the Service.

5. Your content

You keep ownership of the photos, videos and text you add ("User Content"). You grant us a limited, worldwide, royalty-free licence to host, store, transmit, back up and process your User Content solely to provide the Service to you and the people you invite. You are responsible for having the rights necessary to upload your User Content.

6. Intellectual property

The Service itself — including software, design, branding and documentation — is owned by the Seller and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable right to use the Service within the limits of your plan. No other rights are granted.

7. Payment, subscriptions and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewal and cancellation are governed by the Paddle Buyer Terms. Refunds are covered by our Refund Policy.

Subscriptions renew automatically for the same period unless cancelled before the renewal date. You can manage or cancel your subscription at any time from paddle.net or from the links in your purchase emails.

8. Service availability

We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, error-free or always available. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly or seriously violate our policies. You can stop using the Service at any time. On termination, you may export your User Content for a reasonable period, after which it may be deleted.

10. Liability

To the fullest extent permitted by law, our aggregate liability for any claim relating to the Service is capped at the fees you paid us in the twelve months before the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (such as fraud, death or personal injury caused by negligence).

11. Indemnity

You will indemnify us from claims arising out of your User Content, your unlawful use of the Service or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes take effect means you accept them.

13. Governing law

These Terms are governed by the laws of Portugal, the Seller's country of residence, without regard to its conflict-of-laws rules. Disputes will be brought before the competent courts of Portugal, subject to any mandatory consumer protections in your country of residence.
